§ 57 – Publications of Final Measures

(1) The supervisory authorities have to publish on their internet website final measures and decisions on fines that have become res judicta imposed imposed by them because of a violation of this Act or the regulations issued on the basis of this Act after information of the adressee of the measure or decisions on fines. Nature and character of the violation and the natural persons and legal persons or associations of persons responsible for the violation have to be named in the publication.

(2) A publication pursuant to paragraph 1 has to be postponed, as long as the publication

  1. would infringe the right of personality of natural persons or a publication of personal data would be out of proportion for other reasons;
  2. would jeoparadise the stability of the financial markets of the Federal Republic of Germany or one or several Contracting States of the Agreement on the European Economic Area, or
  3. would jeoparadise current investigations.

Instead of a postponement the publication may be made on an anonymised basis, provided that this ensures an effective protection pursuant to sentence 1 Number 1. If it can be forseen that the reasons of the anonymised publication shall cease to exist within a reasonable period, the publication of information pursuant to sentence 1 Number 1 may be postponed accordingly. The publication shall be made if the reasons for the postponement ceased to exist.

§ 57 – Publications of Final Measures

(3) A publication may not be made if the measures pursuant to paragraph 2 are not sufficient to exclude a danger for the financial market stability to ensure the proportionality of the publication.

(4) A publication has to remain published muss on the internet website of the supervisory authority for five calendar years. Personal data are to be deleted, in derogation from sentence 1, as soon as the publication is not required any more.
